President Trump’s executive order with regard to restricting immigration from 7 countries and halting the refugee program is still on hold as the Appeals Court sided with immigrants today, getting the immigration ban issue closer to a US Supreme Court ruling.
President Donald Trump called today’s decision by a 3 member panel as being political, after the federal appeal court unanimously voted against Trump’s ban on travel from 7 predominantly Muslim countries.
Trump went on twitter 26 minutes later and said abruptly:
SEE YOU IN COURT, THE SECURITY OF OUR NATION IS AT STAKE!
— Donald J. Trump (@realDonaldTrump) February 9, 2017
The Ninth Circuit Court of Appeals released a 29 pages ruling via its 3 judge panel concluding that the administration failed to convince them to lift the temporary freeze on the travel ban. They went even further, calling into question the way Trump used his Constitutional powers to limit immigration.
President Trump’s January 27th executive order was aimed at halting the flow of unvetted “refugees”/immigrants from terror prone countries, as per his campaign promises.
The left went berserk and a flurry of protests and lawsuits followed the exec-order all across the US.
According to San Francisco’ (a Democrat stronghold and a sanctuary city) 9th Circuit Court of Appeals:
“The Government has pointed to no evidence that an alien of the countries named in the Order has perpetrated a terrorist attack in the United States.
Rather than present evidence to explain the need for the Executive Order, the Government has taken the position that we must not review its decision at all. We disagree.”
As you can see, there’s no mention about the Constitutionality/legality of the executive order from President Trump. The whole matter is political, as in the judges were not “convinced” that the travel ban is really an important matter, but that’s not the point after all.
A district judge overruling the POTUS on matters of national security and border security in wartime (the War on Terror rings a bell?) is absurd. The Congress should start restricting the jurisdiction of the Supreme Court using Article III, Section 2, of the Constitution and clipping the court’s wings.
Enforcing the law of the land is not a matter of opinion and President Trump has wide powers for limiting immigration it the country. But it’s one thing to win an election and quite another thing to take the power. The battle with the progressive establishment will continue, stay tuned.
