Late on Thursday, a Hawaiian judge ordered a nationwide loosening of the famous travel ban exec-order of President Trump. US District Judge Derrick Watson in Honolulu, an Obama appointee obviously, ruled that grandchildren, grandparents, uncles, aunts and cousins are no longer affected by the travel ban imposed on six Muslim-majority countries.
Thursday’s decision is a new legal blow for the POTUS and it comes just a couple of weeks after the Supreme Court’s ruling allowed Trump’s administration to proceed with implementing the travel ban against foreign nationals and refugees from 6 countries in the Middle East who have no connection with the United States.
The SCOTUS ruled that the travel-ban executive order can be reinstated, provided it doesn’t affect people with bona fide relationships to organizations/other people in the US. The US District Judge Derrick Watson ruling (which is to be applied nationwide) says that people with broader family ties will also be exempt from the travel ban. The judge wrote:
“The Government’s definition of close familial relationship is not only not compelled by the Supreme Court’s June 26 decision, but contradicts it,”
So a judge thinks he can change immigration law, by just issuing a decree. Immigration law defines close family ties as siblings , parents and children. Fiances were an addition. If any judge thinks they are above the law, it is the judge in this case. Fast track to US Supreme Court.
Flabbergasting how an activist judge from Hawaii can override not only the President’s constitutionally mandated authority but also the 9-0 ruling from highest court in the land.
Something is seriously wrong with this picture.How is it that a lower court judge can make a ruling that basically nullifies a supreme court ruling? Am I missing something?The Japanese have a saying: the nail that sticks out gets hammered down hard. Trump should go all Andrew Jackson and ignore him.
